Terms of Service for ScrapDataPro Zillow Scraper Chrome Extension

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the ScrapDataPro Zillow Scraper Chrome Extension (the "Extension") operated by ScrapDataPro ("us", "we", or "our").

Your access to and use of the Extension is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Extension.

By accessing or using the Extension, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Extension.

1. Description of Service

The ScrapDataPro Zillow Scraper Chrome Extension is a browser-based tool designed to assist users in extracting publicly available data from the Zillow.com website for their personal, analytical, or business purposes. The Extension functions by automating browser interactions and collecting data displayed within your browser.

Important Note: The Extension operates locally within your Chrome browser. ScrapDataPro does not store, collect, or transmit any scraped Zillow data on its servers. All data processing and storage occur on your local machine.

2. User Obligations and Compliance

By using the Extension, you represent and warrant that:

  • Compliance with Zillow's Terms of Service: You understand and agree that your use of the Extension to scrape data from Zillow.com must strictly comply with Zillow's own Terms of Service. It is solely your responsibility to review and adhere to Zillow's policies regarding data collection, automated access, and use of their platform. ScrapDataPro is not affiliated with Zillow, and we do not endorse or authorize any activity that violates Zillow's terms.
  • Legal and Ethical Use: You will use the Extension only for lawful and ethical purposes. You will not use the Extension to collect data that is illegal, infringes upon intellectual property rights, violates privacy laws (such as GDPR, CCPA, etc.), or is otherwise harmful, fraudulent, or misleading.
  • No Resale or Redistribution: You will not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Extension or access to the Extension without express written permission from ScrapDataPro.
  • Accuracy of Information: You are solely responsible for verifying the accuracy and completeness of any data scraped using the Extension. ScrapDataPro does not guarantee the accuracy, completeness, or timeliness of scraped data.

3. Payment and Subscription (via Lemon Squeezy)

  • Payment Processing: All payments for the Extension, including subscriptions or one-time purchases, are processed securely through Lemon Squeezy, our merchant of record. We do not directly collect or store your credit card information or other sensitive payment details. Your payment information is handled directly by Lemon Squeezy in accordance with their privacy policy and terms of service.
  • Refunds: Due to the nature of digital goods and services, all sales are final, and refunds are generally not offered unless required by law. Please review our refund policy, if any, on the purchase page or contact us directly for specific inquiries.
  • Subscription Renewals: If the Extension is offered on a subscription basis, your subscription will automatically renew at the end of each billing period unless you cancel it. You are responsible for managing your subscription through the Lemon Squeezy portal or by contacting us.

4. Intellectual Property

The Extension and its original content (excluding data scraped from Zillow), features, and functionality are and will remain the exclusive property of ScrapDataPro and its licensors. The Extension is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ScrapDataPro.

5. Disclaimer of Warranties

The Extension is provided on an "AS IS" and "AS AVAILABLE" basis. ScrapDataPro makes no representations or warranties of any kind, express or implied, as to the operation of their Extension or the information, content or materials included thereon. You expressly agree that your use of the Extension is at your sole risk.

ScrapDataPro does not warrant that a) the Extension will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Extension is free of viruses or other harmful components; or d) the results of using the Extension will meet your requirements.

6. Limitation of Liability

In no event shall ScrapDataPro, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Extension; (ii) any conduct or content of any third party on the Extension; (iii) any content obtained from the Extension; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Indemnification

You agree to defend, indemnify, and hold harmless ScrapDataPro and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Extension, by you or any person using your account and password; b) a breach of these Terms, including, but not limited to, your failure to comply with Zillow's Terms of Service or any applicable laws related to data scraping.

8. Termination

We may terminate or suspend your access to the Extension immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
